Terms and Conditions

1. General Provisions

1. These Terms and Conditions (the “Terms”) set out the rules for using the website available at incite.pl (the “Website”) and the conditions for the provision of services by electronic means within the meaning of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means.
2. The operator of the Website and the service provider is Incite sp. z o.o., with its registered office in Warsaw at Rondo Ignacego Daszyńskiego 2B, 00-843 Warsaw, Poland, KRS 0000983382, NIP 5252916758, REGON 522659605 (the “Service Provider”). Contact: office@incite.pl, phone +48 517 026 850.
3. A user is any person using the Website (the “User”).
4. Use of the Website constitutes acceptance of these Terms. The Terms are made available on the Website free of charge, in a form that allows them to be obtained, reproduced and stored.

2. Types and Scope of Services Provided by Electronic Means

Through the Website, the Service Provider provides the following services free of charge:

1. access to information content concerning the Service Provider’s business and services;
2. a contact form – enabling Users to submit enquiries to the Service Provider;
3. a consultation booking form – enabling Users to book a free consultation;
4. a newsletter – delivery of commercial information to the e-mail address provided, subject to separate consent.

The services provided through the Website are of an informational and contact nature only. Any professional services (accounting, advisory or other) are provided solely on the basis of a separate agreement concluded outside the Website.

3. Technical Requirements

Use of the Website requires:

• a device with Internet access;
• an up-to-date web browser with JavaScript and cookies enabled;
• an active e-mail account – for the use of forms and the newsletter.

The Service Provider will use reasonable efforts to ensure the continuous and correct operation of the Website; however, it reserves the right to temporary technical interruptions related to maintenance, updates or development of the Website.

4. Conclusion and Termination of Electronic Service Agreements

1. The agreement for the browsing of Website content is concluded upon entering the Website and terminated upon leaving it.
2. The agreement for the contact form or consultation form service is concluded upon completion and submission of the form, and terminated upon the Service Provider’s response or the conclusion of the correspondence.
3. The newsletter agreement is concluded upon sign-up and consent. The User may terminate it at any time by clicking the unsubscribe link included in every message or by sending a request to office@incite.pl.

5. Rules of Use

1. The User is obliged to use the Website in a manner consistent with the law, good practice and these Terms.
2. The User is prohibited from providing unlawful content, including content that infringes third-party rights or is vulgar, offensive or misleading.
3. Any actions that may disrupt the operation of the Website are prohibited, in particular interference with its content or technical elements, sending unsolicited commercial information (spam) and the use of malicious software.

6. Intellectual Property

1. All content published on the Website – including texts, graphics, logotypes and the layout and composition of the Website – is the subject of rights held by the Service Provider or entities with which the Service Provider has concluded relevant agreements, and is protected under copyright and industrial property law.
2. Website content may be used solely within the scope of permitted personal use. Copying, distributing or otherwise using the content for commercial purposes requires the prior written consent of the Service Provider.

7. Nature of Content and Liability

1. Content published on the Website is for information purposes only and does not constitute legal, tax, accounting or investment advice, nor an offer within the meaning of Article 66 of the Polish Civil Code, unless expressly stated otherwise.
2. Any decision made on the basis of Website content without obtaining individual advice is taken at the User’s sole risk. Individual advisory services are provided solely under a separate agreement.
3. The Service Provider shall not be liable for interruptions in the operation of the Website caused by circumstances beyond its control, for content published on external websites linked from the Website, or for the consequences of using the Website in breach of these Terms.
4. The limitations of liability do not exclude or limit the Service Provider’s liability to the extent that such liability cannot be excluded or limited under mandatory provisions of law, in particular with respect to consumers.

8. Complaints

1. Complaints concerning the operation of the Website or services provided by electronic means may be submitted to office@incite.pl or in writing to the Service Provider’s registered office.
2. A complaint should include contact details of the complainant and a description of the issue.
3. The Service Provider shall consider complaints within 14 days of receipt. The response is sent to the address indicated by the complainant.
4. A User who is a consumer may use out-of-court complaint and redress procedures, including the assistance of municipal or district consumer ombudsmen and proceedings before permanent consumer arbitration courts operating at the Trade Inspection Authority.

9. Personal Data and Cookies

1. The controller of Users’ personal data is the Service Provider.
2. The rules for the processing of personal data and the use of cookies are set out in the Privacy Policy available on the Website.

10. Final Provisions

1. The Service Provider reserves the right to amend these Terms for important reasons, in particular in the event of changes in the law, the scope of services provided or the functionality of the Website. The amended Terms are published on the Website and apply from the date indicated therein. Continued use of the Website after the amendments take effect constitutes their acceptance.
2. In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular the Civil Code, the Act on the Provision of Services by Electronic Means and the Consumer Rights Act.
3. Disputes arising from the use of the Website shall be resolved by the court having jurisdiction under the provisions of the Polish Code of Civil Procedure.
4. These Terms enter into force on 1 August 2026.
